THESE TERMS OF USE constitute an agreement ("Agreement") made between Law Offices of Richard G. Perque, LLC dba Quick Divorce Now ("Quick Divorce Now") and any person accessing Quick Divorce Now's website ("You") with respect to your access to and use of the website, including any content, functionality, and services offered or delivered on or through the domain quickdivorcenow.com and any other domain used by Quick Divorce Now that specifically incorporates the terms of this Agreement (collectively, the "Site"). You agree to abide by all of the terms contained in this Agreement as a condition of your continuing to access, view or use the Site. Quick Divorce Now and You are collectively referred to as the parties.
These Terms of Use govern the use of any and all of Quick Divorce Now’s web properties, forms, data, information, resources, or services, and communications with or exchange of information between you and Quick Divorce Now or its employees, through the Quick Divorce Now platform or other media. Quick Divorce Now provides legal services while utilizing an integrated software platform. The information we provide and the content on our website is legal information, is provided for your private use and does not constitute legal advice.

Quick Divorce Now does not provide online legal representation or legal advice, only a licensed attorney can do that. You also understand that in order to perform the services on your behalf, You will need to enter into an attorney client agreement detailing the specific terms of representation.  
    1. Legal services on your case will not begin until after we have received your fee and a signed copy of the attorney client agreement, unless the attorney decides otherwise.  Use of this site by You or your contact with Quick Divorce Now by e-mail or otherwise will not establish an attorney-client relationship between You and Quick Divorce Now unless and until an authorized Quick Divorce Now attorney expressly and explicitly agrees IN WRITING that Quick Divorce Now will undertake an attorney-client relationship with You. As a result, You should not transmit any confidential or sensitive information to us until a formal attorney-client relationship has been established.
    2. You understand that there has been no guarantee made regarding the disposition of any phase of your case. All expressions, which relate to the possible results in your case, are based strictly on opinion. Likewise, it is impossible to determine in advance the amount of time needed to complete your case. The total fees and costs to be expended in your case cannot be anticipated and assurances of what those fees and costs will ultimately be.
    3. We reserve the right to terminate the attorney client agreement for any of the reasons provided in the attorney client agreement.
    4. Client understands that the attorney client contract and the law Quick Divorce Now’s responsibility under the contract terminates upon the entry of a final judgment of divorce. In the event additional proceedings are requested, the parties shall enter into a new contract.
1. Site Description
a. Description. The Site is proprietary to Quick Divorce Now and is protected by intellectual property laws and international intellectual property treaties. Your access to the Site is licensed and not made available unconditionally to You. Subject to the terms and limitations set forth in this Agreement, Quick Divorce Now agrees to provide You with a personal, non-transferable and non-exclusive right to access, view and use the Site.

b. Accessibility. You agree that from time to time the Site may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs which Quick Divorce Now may undertake from time to time; or (iii) causes beyond the control of Quick Divorce Now, whether or not foreseeable. Quick Divorce Now will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period

c. Equipment. You shall be solely responsible for providing, maintaining and ensuring compatibility with the Site, all hardware, software, electrical and other physical requirements for your use of the Site, including, without limitation, telecommunications and Internet access connections and links, web browsers or other equipment, programs and services required to access and use the Site.

2. Limitations
a. Security. You are solely responsible for maintaining the confidentiality of your password and account and for any and all statements made and orders, acts, or omissions that occur through the use of your password and account. Therefore, you must take steps to ensure that others do not gain access to your password and account. Our personnel will never ask you for your password. You may not transfer or share your account with anyone, and we reserve the right to immediately terminate your account if you do transfer or share your account.
b. Privacy. You agree that all information You provide to the Site or we collect about You, including but not limited to through the use of any interactive features on the Site, is governed by our Privacy Notice, which can be found at https://www.quickdivorcenow.com/privacy, and You consent to all actions we take with respect to your information consistent with our Privacy Notice.

c. Nature of Site Content. Quick Divorce Now makes information available on this Site as a service to our clients and other friends for informational purposes only. The materials on this Site are not intended to constitute advertising, solicitation or legal advice, and transmission of the information from this Site is not intended to, nor does it, create an attorney-client relationship between Quick Divorce Now and You or anyone else. This Site is not intended to be used as a substitute for specific legal advice, nor should You consider it as such. You should not act (or refrain from acting) based upon information in this Site without obtaining professional advice regarding your particular facts and circumstances.

3. Intellectual Property
For purposes of these User Terms, content is defined as any information, data, communications, software, photos, video, graphics, music, sounds, compilations, databases and other material and services that can be viewed by users on our site.
Quick Divorce Now is the exclusive online distribution channel for any content or information created and distributed by Quick Divorce Now. This website is the only website authorized to display or otherwise use in any manner the information displayed hereon, and the information created by Quick Divorce Now. This is a specific prohibition against data scraping for any use whatsoever to which you specifically agree. The use of automated systems or software to extract data from any Quick Divorce Now web property, or extracting such data manually, data scraping is specifically prohibited unless the third party has a written license agreement with Quick Divorce Now in which permits it access to Quick Divorce Now’s protected information, and in such case the use of any such information is directly governed by such written license agreement.

Nothing in these User Terms grants you any right to use any trademark, service mark, copyright, logo, and/or the name of Quick Divorce Now or its Affiliates in any way without obtaining the prior written approval of Quick Divorce Now.
You hereby explicitly agree you will not reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, techniques, processes, algorithms, know-how or other information from Quick Divorce Now’s services, technology, products, code, etc. (collectively, Reverse Engineering) or permit or induce the foregoing. If however, directly applicable law prohibits enforcement of the foregoing, you may engage in Reverse Engineering solely for purposes of obtaining information to the limited extent permitted by directly applicable law, but only if: (a) Reverse Engineering is strictly necessary to obtain such information; and (b) you have first requested such information from Quick Divorce Now and Quick Divorce Now failed to make such information available (for a fee or otherwise) under reasonable terms and conditions. Any information supplied to or obtained by you under this section is confidential information of Quick Divorce Now subject to the non-disclosure and confidentiality obligations to be determined with respect to the information obtained and will not be disclosed to any third party or used to create any software which is substantially similar to the expression of Quick Divorce Now’s technology. Additionally, you specifically agree to not cause any other party to attempt to Reverse Engineer any of Quick Divorce Now’s services or products, whether you have a license to use Quick Divorce Now’s services or not. As the damages to Quick Divorce Now from the Reverse Engineering of Quick Divorce Now’s services or product would be substantial, you specifically agree that Quick Divorce Now may request and obtain immediate injunctive relief in addition to any other remedy in law or equity. You additionally explicitly agree to liquidated damages in the amount of the minimum mandatory statutory damages allowed under law, or $1,000,000 per product or service Reverse Engineered or attempted to be Reverse Engineered; whichever is higher. You explicitly agree that this amount of liquidated damages is not intended to be, and does not, constitute a penalty; and is agreed by you and Quick Divorce Now to reflect the actual damage that would be suffered Quick Divorce Now from any Reverse Engineering or attempted Reverse Engineering of its products, services, or other technology. For the purposes of this prohibition against Reverse Engineering, you specifically agree that source code, techniques, processes, algorithms, know-how or other information specifically related to services or products that appears to be substantially similar to Quick Divorce Now’s, which was 1) created, developed, published or otherwise used after the substantially similar source code, techniques, processes, algorithms, know-how or other information was first developed by Quick Divorce Now, and was 2) created, developed, published or otherwise used after you or any affiliated party had access, whether by creating an account with Quick Divorce Now or through any means, to view or experience Quick Divorce Now’s source code, techniques, processes, algorithms, know-how or other information specifically related to services or products, creates a rebuttable presumption that such content was impermissibly Reverse Engineered from Quick Divorce Now.
4. Prohibited Uses
In addition to the above, You are solely responsible for any and all of your acts and omissions that occur when using the Site, and You agree not to engage in unacceptable use of the Site, which includes, without limitation, use of the Site to: (a) violate federal, state, local or international law or regulation, or generally accepted practices or guidelines in relevant jurisdictions; (b) transmit unsolicited messages, chain letters, email, or other unsolicited commercial communications; (c) transmit files, graphics, software or other material that actually or potentially infringes the copyright, trademark, patent, trade secret or other intellectual property right of any person; (e) transmit or introduce any spyware, viruses, malware, ransomware, Trojan horses, worms, keystroke loggers, rootkits, logic bombs or other material which is malicious or technologically harmful to the Site (or the servers, networks, and databases which are connected to the Site); (f) engage in any activity that interferes with or disrupts the Site (or the servers, networks, and databases which are connected to the Site); or (g) engage in any other activity deemed by Quick Divorce Now to be in conflict with the spirit or intent of this Agreement.

5. Linking to the Site and Social Media Features
You may link to our homepage, provided You do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but You must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part without our express written consent.
We may disable all or any social media features and any links at any time without notice in our discretion.

6. Termination
This Agreement is effective upon your access or use of the Site and shall continue in full force until terminated. Quick Divorce Now reserves the right, in its sole discretion and without notice, at any time and for any reason, to:

(a) remove or disable access to all or any portion of the Site;

(b) suspend your access to or use of all or any portion of the Site; and

(c) terminate this Agreement.

7. Disclaimer

By providing information to the Firm for the use of the Firms Services, you hereby expressly authorize the Firm to use the information pursuant to its published Privacy and Data Use Policy, the entirety of which is incorporated into these Terms as if reproduced in full herein.
No representation is made that the quality of legal services to be performed is greater than the quality of legal services performed by other lawyers.
8. Limitation of Liability
You specifically agree that the information provided by you is correct and factual to the full extent such information is or should be known to you, and that the information is otherwise appropriate for use. Use of the platform in a fraudulent manner, or otherwise providing information you know or should know is incorrect, is a violation of these Terms for which you shall be liable to the Firm. Your liability for such use or providing such information extends to all damages suffered by the Firm and related to the use and or information.
9. Indemnification
You agree to indemnify, hold harmless and defend Quick Divorce Now, its shareholders, attorneys, directors, officers, employees and agents from and against any action, cause, claim, damage, debt, demand or liability, including reasonable costs and attorneys' fees, asserted by any person, arising out of or relating to: (a) your use of the Site, including any data or work transmitted or received by You; and (b) any unacceptable use of the Site, including, without limitation, any statement, data or content made, transmitted or republished by You which is prohibited as unacceptable in Section 4 of this Agreement.

10. Miscellaneous
a. Waiver. No waiver of any term, provision or condition of this Agreement, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or shall constitute, a waiver of any other term, provision or condition hereof, whether or not similar, nor shall such waiver constitute a continuing waiver of any such term, provision or condition hereof. No waiver shall be binding unless executed in writing by the party making the waiver.

b. Notice. All notices shall be in writing and shall be deemed to be delivered when sent by e-mail to either parties' last known e-mail address. You hereby consent to notice by e-mail.

c. Choice of Laws. This Agreement is made in and shall be governed by the laws of the State of Louisiana without reference without reference to its choice of law provisions. All lawsuits, actions, claims or disputes arising under or relating to this Agreement shall be brought in the federal or state courts within Orleans Parish, Louisiana. The parties irrevocably submit and consent to the exercise of subject matter jurisdiction and personal jurisdiction over each of the parties by the federal and/or state courts within Orleans Parish, Louisiana. The parties hereby irrevocably waive any and all objections which any party may now or hereafter have to the exercise of personal and subject matter jurisdiction by the federal or state courts within the Orleans Parish, Louisiana and to the appropriateness of the venue of any such lawsuit, action or proceeding brought in any such federal or state court within Orleans Parish, Louisiana.

d. Attorney's Fees. If any action in law or in equity is necessary to enforce the terms of this Agreement, Quick Divorce Now solely shall be entitled to reasonable fees of attorneys, accountants, and other professionals, and costs and expenses in addition to any other relief to which Quick Divorce Now may be entitled.

e. Headings. The captions and headings of this Agreement are included for ease of reference only and will be disregarded in interpreting or construing this Agreement.

f. Waiver, Severability, & Assignment. Quick Divorce Now’s failure to enforce or decision not to enforce a provision at any particular time is not a waiver of our right to do so later. If any provision of these Terms is found unenforceable, the remaining provisions of these Terms will remain in full effect and an enforceable term reflecting our intent as closely as possible will be substituted for the unenforceable term. You may not assign any of your rights under these Terms, and any such attempt will be void. Quick Divorce Now may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest.

By accepting these Terms of Use at any time, you specifically agree to be bound by these Terms of Use for any and all transactions placed by you or on your behalf, and any continued use of Quick Divorce Now subsequent to any agreement to these Terms specifically ratifies your agreement to be so bound.
By continuing to use or access the Services after any revisions come into effect, you agree to be bound by the revised Terms. If you do not wish to be bound by these Terms after a previous acceptance, please immediately discontinue use of the site, as any transaction placed will be subject to these Terms as published.
